Terms of Use

Last updated: 23 June 2026

These Terms of Use (the “Terms”) govern your access to and use of the Mortgage AI website, applications, and services (together, the “Service”), operated by Mortgage AI (“Mortgage AI,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Mortgage AI is — and is not

Mortgage AI is a technology and referral platform for business-purpose funding. You send one request about your business, and we pass it to a licensed funding partner who contacts you and presents any offer. We are a matching and information service only. The Service is for business-purpose funding requests only; it is not for personal, family, or household loans.

Any decision to apply for, accept, or sign any funding product is solely between you and the relevant licensed provider. You should review all terms directly with that provider and seek independent professional advice before entering into any agreement.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service you represent that the information you provide is true, accurate, and complete, and that you are submitting your own information or have authority to submit it.

3. How matching works

When you submit a request, we use it to match you with licensed partners who may be able to serve you. We do not sell or resell your contact information. We share your details only with partners relevant to your request and, where required, with your consent. Partners are independent third parties; we do not control and are not responsible for their products, decisions, conduct, or compliance.

4. Your responsibilities

5. No warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information, offer, or result will be accurate, available, or suitable for you.

6. Limitation of liability

To the fullest extent permitted by law, Mortgage AI and its officers, founders, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, any partner offer or product, or any decision you make based on the Service. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).

7. Indemnification

You agree to indemnify and hold harmless Mortgage AI and its founders, employees, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

8. Third-party links and content

The Service may contain links to or content from third parties. We are not responsible for third-party websites, products, services, or content, and including them does not imply our endorsement.

9. Intellectual property

The Service, including its content, design, logos, and trademarks, is owned by Mortgage AI or its licensors and is protected by applicable laws. You may not use, copy, or reproduce it without our prior written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Changes to the Service and these Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may update these Terms from time to time; the “Last updated” date above reflects the latest version. Your continued use of the Service after changes take effect means you accept the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where applicable consumer-protection law requires otherwise. Any dispute will be resolved on an individual basis (not as a class action) in the courts or by binding arbitration as permitted by applicable law. Nothing in these Terms limits any non-waivable rights you may have under the law of your place of residence.
